Legal Agreement: Terms of Service

Coworking Whistler reserves the right to update the below Terms and Conditions which must be adhered to at all times. Failure to do so may result in termination of your membership and access.

**Use of Space:**

Your application for membership does not constitute a tenancy of any kind or sublease, but a prepaid usage license to use the assigned work space on the date or dates agreed, for general business/academic/creative use as pre-approved by Coworking Whistler. Space can only be used for general office/academic/creative purposes, not for any activities involving chemicals, loud noise, or anything else that would disturb the comfort and quiet enjoyment of other members. No on-premises retail sales or any unlawful activities. Memberships are non-transferable. Everyone working in the space must have an active membership with the exception of occasional guests or clients you are meeting with. You may not share your private access code with anyone else. Memberships include use of a designated desk between 9am and 5pm. Permanent, or monthly members can request access outside these hours between 5am and 11pm. Use outside of these hours is approved in writing with bookings@rentalswhistler.ca and is approved by the building’s owner. You may not use it outside these hours until you get written approval. No members may stay overnight on the premises. Any use of the building or premises outside of these agreed hours will have their membership terminated immediately with no refund given.

**Membership Fees:**

You will be charged for your membership at the time of booking. If you are booking multiple months, we can arrange payment on a monthly basis. Payment terms are outlined with agreements based on being winter, summer, monthly, weekly or daily in agreement.

**Cancellation Policy:**

Daily or weekly members will receive a full refund if you cancel your Membership 30 days or more before your first start date. Should you cancel within 30 days or during your booking period, you will not receive a refund. If you are already a monthly member and are booking for multiple months, you may terminate your agreement with 30 days notice before the first of each month, at no penalty. If you cancel with less than 30 days notice, you will be charged for the next month. If you cancel during your booking period, there is no refund. Cancellation must be in writing to bookings@rentalswhistler.ca with your name, date, the notice you are giving, and last date at Coworking Whistler listed, to be valid.

**General Health Safety:**

For the comfort and safety of all our members, we ask that you wash hands or hand sanitize on arrival and prior to/after using any shared facilities – bathroom, coffee station, printer, etc. Hand sanitizer is provided. If you feel sick or experience any Covid or other flu-like symptoms, please stay home. Covid test kits are available free of charge in the kitchen - second drawer.

**Internet Usage:**

Wireless high-speed internet is available for regular office use. Please use the WiFi responsibly – no illegal bit-torrent, digital currency mining, unlawful downloads, or activities permitted. You may not use the internet in any way that could damage, disable, overburden, or impair any other Member. Coworking Whistler cannot provide any refund should the internet not function due to events beyond their control. Coworking Whistler is not responsible for any loss of data, information, business, goodwill, or otherwise as a result of such interruptions. Coworking Whistler cannot guarantee the security/privacy of the internet, WiFi system, or hosting services, or of any data or information that you send/receive by using the Internet. You are responsible for protecting your own computers, devices, data, information, business, and goodwill from damage or interference, including but not limited to viruses or malware.

**Mail/Packages/Address:**

You may not use Coworking Whistler as your permanent mailing address in connection with your business, nor can you receive packages or mail to the address. Mail delivery is not a service we offer.

**Member Etiquette – Sharing and Mutual Respect:**

Please treat the location and other members with respect. We strive to ensure this is a safe and welcoming workspace, free of discrimination or harassment. Please respect other members' right to privacy, quiet, and confidentiality with regards to their personal property and data as you would expect to be treated yourself. Both physically and emotionally, be mindful of others' space and boundaries. Bookings have a dedicated desk and may leave their belongings on their desk. Avoid borrowing items, perusing others' belongings, or leaving any of your belongings on other desks. Please use headphones for phone calls or music and speak quietly. You may take occasional calls from your desk if you use headphones and speak quietly or when available you may take calls from the communal kitchen area, although we can not guarantee quiet or privacy in the kitchen area as members will still need to be able to access the kitchen throughout the day. We encourage you to embrace the co-working spirit by bringing noise-canceling headphones for those moments when silence is golden. While it's essential to respect focused work, don't hesitate to engage in small talk with fellow co-workers. Inquire about their day or upcoming weekend plans; you might discover shared interests beyond the office environment, or even find your next business partner. Please keep your desk area, bathroom, and the communal kitchen area clean and tidy after use. Dish soap is provided and members should wash their own dishes and leave them on the drying rack. Please rinse your containers before putting them in recycling. Regular cleaning and garbage removal will be provided. Anything left in the Fridge after 5pm on Fridays will be thrown away. No smoking or vaping or use of illegal drugs is permitted in the office space or building. Alcohol is permitted but within moderation. Intoxication in the office is not tolerated. Pets are allowed but must be approved prior to any booking. All pets must be toilet trained and you are responsible for taking them out every 2-3 hours to relieve themselves and they may not be bothering other members. We reserve the right to ban any pets that are unruly, noisy, aggressive, or if we receive complaints from other members. No refunds will be issued because your pet was banned. Do not hang anything on the walls or mark your designated area. Do not place any signs, flags, banners, or other advertising materials in or outside the premises. Please turn off all lights, air conditioning units, and baseboard heaters if you are the last to leave. Please close all windows if heaters or air conditioning are on, and if you are the last to leave. In summer and winter seasons please keep the blinds down when relevant.

**Storage:**

Coworking Whistler takes no responsibility for lost, stolen, or damaged property. During the winter season permanent, monthly or weekly members are permitted to store one snowboard or set of skis onsite in our gear storage area for the duration of their booking. No items such as stand up paddle boards or other recreational items can be stored onsite. During the summer season no bikes are allowed on site, unless otherwise agreed and bike storage has been purchased as an add-on. All bike add-ons must be approved first by Coworking Whistler. By purchasing a bike add-on you agree to the following terms of use: Any dirty bikes must be cleaned and dried off properly using the cleaning station outside Pangea Pod Hotel Bikes must be carried, not walked both up the stairs and over the carpet of floor two Pieces of Mr White magic erasers are available in the kitchen and if you do happen to put a scuff mark on a wall while carrying a bike, you will clean it off right away By purchasing bike storage, you are agreeing to follow these rules. Anyone who doesn't follow these rules will have their bike storage revoked without a refund. If venturing outdoors during your the day, remember to clean off your shoes or boots before returning inside. Please note that we take several measures in ensuring the space is secure as possible but all items are left at the owner's risk. You must never leave the front door of the space left ajar. As a small autonomous space this door and it’s access is monitored and must be closed at all times.

**Guests:**

You may bring an occasional guest to your work area for a quiet meeting if needed, but you must be present during the entire time that such Guest is on the Premises. You may not share your access code with your guest. Your guest may not use a separate desk without paying for their own membership.

**Termination / Refunds:**

Members may terminate this Agreement by giving 30 days' notice. You will not receive a refund in the event that you terminate your Membership without a full month’s notice. Coworking Whistler may immediately terminate this Membership Agreement if you fail to comply with the Terms & Conditions, if any outstanding fees are late, or if your use of the space is disturbing other members. Coworking Whistler reserves the right to terminate your membership without or by giving 30 days' notice based on the agreed terms in our membership conditions. In the event Coworking Whistler decides to terminate your membership, except for just cause, you will receive a prorated refund for any remaining period of membership already paid.

**Damage:**

You will be responsible for any damage you cause to the building or its contents. Any members who cause damage, exceeding normal office wear and tear will incur the full costs of the repair or professional cleaning.

**Insurance:**

Coworking Whistler carries Business Property and Liability insurance, but this does not cover your personal property. It is strongly recommended that you carry an insurance policy to cover your equipment and personal belongings.

**Security:**

The space is controlled by an electronic locking system, which is programmed to give you access during your membership period. Do not give access to the space to anyone else during your membership. Should you witness or experience anything untoward, please report this to Coworking Whistler right away. Coworking Whistler reserves the right to disclose any information about you only should this be deemed necessary to satisfy any applicable laws, regulations, legal, or government processes.

**Release and Indemnity:**

Without exception, the Member releases, and hereby agrees to indemnify, defend, and save harmless Coworking Whistler and Whistler Sauna Rentals Inc (whether or not wholly-owned), affiliates, divisions, and their past, present, and future officers, agents, shareholders, members, representatives, employees, successors, and assigns, jointly and individually, from and against all claims, liabilities, losses, damages, costs, expenses, judgments, fines, and penalties, (including, but not limited to, damages for: loss of profits, loss of confidential or other information, corruption of data, business interruption, personal injury, loss of privacy, failure to meet any duty (including of good faith or of reasonable care), negligence, and any other pecuniary or other loss whatsoever) based upon or arising out of Member’s or Member’s guests' actions, errors, and omissions, willful misconduct, and fraud. Member further agrees that in the event the Member brings a claim or lawsuit and the matter is found to be without merit in part or in whole, Member shall be liable for any reasonable attorneys’ fees and costs incurred by Coworking Whistler or its respective officers and agents in connection with the defense of such claim or lawsuit.

**Membership Agreement Acceptance:**

By booking & creating a member profile you hereby acknowledge that you have read and understood all of the terms and conditions contained in this Agreement and further agree to be bound by the Agreement regarding my participation in and use of the Premises and Membership Services, including any updates or variations to this agreement in the future. You will be notified of any updates to this agreement. If you are using the space or Services on behalf of an Organization, then you are agreeing to these Terms and Conditions on behalf of that Organization, and you represent and warrant that you have the authority to bind the Organization to this agreement.
